Could share how long you together and what Is her activities in State since you married?
what if the EU person is still exercising the treaty rights in the state and seek for a divorce from her home country? I read many cases where divorce was done outside of the state while exercising the treaty rights and the non eu was able to retain his treaty rights? Could some one ligh me up here please.
I said if the person leaves the state and travel to a 3rd Country to divorce with the intention of not returning, then they do not qualify.

This is not me saying it. It is the law. All cases are different, but the fact that the department issued does not mean it is the law. It may well be the case, that the facts of your case are different.
