I have leveraged and learnt alot from the information on this forum. I am in the process of applying for my Wife who is a Non Eu national and i am a British National. She got her Family Permit in November 2012 and 5 year Resident Card in May 2016. We both came together to UK from Malta on the 27th November 2012. My first job started in the UK on the 10th January 2013 and since then i have been employed to date i.e approx 5 years.
I am nearly there in terms of finalising the application and documentation needed to support the application and had a few queries which i wanted to get some advice on from experienced members of the forum here.
a) Timing of the Application - 5 Years qualifying period would start from 27th November 2013 or is it advisable to stick to 10th Jan 2013 ( i.e when i started work). Prior to Jan 2014, I was looking for jobs and we moved in to our own property from January 2013 onwards too as such a lot of my supporting documentation i.e bills, tenancy agreement etc are all from Jan 2013. I dont really have much documentation for Nov/Dec as we stayed with family. Is it advisable to wait sometime perhaps End Jan and then apply? I have all supporting documentation for the last 5 years starting from Jan 2013. What is recommended? Alternatively i could include emails/applications that i was looking for jobs between Nov/Dec but would also struggle to provide any bills etc. Thoughts /Advice on this?
b)Section 5.3 - Absence from UK ( You and Sponsor) - in the guidelines Absences are described as
' Please note, you only need to list your absences where you have been out of the UK for more than 6 months in total in any 12 month period. You do not need to list any absences that were before your qualifying period of residence." We haven't been away from UK for 6 months but have taken short holidays here and there, am i correct we dont need to include these?
c) Any common errors or pitfalls to avoid in the application?
d) Can the passport be requested back midway? would this impact anything? if so how can that be done?
e) What is the standard timeframe for a processing ? 6 months?
f) Provided we get the permanant residence, can my wife apply for British passport straight away?
