Established Presence for the dependant of a Doctorate Extension Scheme

Post by questionguy65 » Sat Dec 30, 2017 6:45 pm

Hi all,

I know that the rules for established presence i.e. 2 months of maintenance for living cost instead of maximum of 9 months has been removed. I also realised that for Tier 4 Doctorate Extension Scheme, the established presence rules still remains.

My question is this: what needs to be shown for the dependant of an applicant for Tier 4 Doctorate Extension Scheme? Does established presence applly to the dependants as well? Does it matter if they apply at the same time or separately?

Thanks in advance

I am little bit confused as I saw this:

"68.If you are applying as the dependant of a Tier 4 student who is on the doctorate extension
scheme, you will need to demonstrate maintenance for a period of 2 months."

From:

https://www.gov.uk/government/uploads/s ... n_2017.pdf

Could anyone verify?

Thanks.

This is one of those cases where the guidance says something different than the rules. Appendix E para (ba)(i) of the immigration rules says you need 9 months, but that para of the PBS Dependants guidance says 2 months.

The PBS Dependants guidance is full of errors, hence I did not advise that you rely on it. But I see that the modernised guidance for caseworkers now also says 2 months, so it should be safe to rely on that paragraph of the guidance after all. See pages 43-46 of
