UK tier 4 dependant visa refused :(

Post by Folu » Sat Dec 30, 2017 8:05 pm

My daughter and husbands Visa was refused the second time. The first time the ECO said te marriage was not subsisting. This time it was based on the fact the money fell short for few days with just a few pounds and the opening and closing balance was still up to the required amount. Also the date of application stated on the refusal letter was wrong and so the calculation arrived at looks to me that it is wrong. Can I call for a review. especially on human rights ground as I have a three year old daughter that has been crying to see her mother. Myself, my husband and my daughter have never stayed apart for this long before now. Its becoming traumatic and affecting my studies.

Ask the international student adviser at your university for advice. From what you say, it sounds like it was your or the applicant's error with the amount of money, not the ECO's calculation error.

Either way, it does not seem to be a human rights matter. I'm afraid that was your choice to come to the UK without knowing that your family had visas to join you, and you could have chosen to postpone your studies until you had confirmation that you could all come to the UK.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Even if the money goes down for a one minute bellow the required amount the visa will be refused.
Also the date of application stated on the refusal letter was wrong and so the calculation arrived at looks to me that it is wrong.
What you mean ? Explain this ifurther
Can I call for a review. especially on human rights ground as I have a three year old daughter that has been crying to see her mother. Myself, my husband and my daughter have never stayed apart for this long before now.
Not at all. They could say that if your daughter needs you that much why don't you go back and leave the UK. It will be waste of time and money
Its becoming traumatic and affecting my studies.
End of day its your call either face the time or give up and go back to your family.

I suggest don't take much stress. Get proper funds in your account as required and they apply again. There is no point of applying Admin review if your balance was below required even for a minute
