I dont want to be a victim of domestic Violence!

Post by jbentley009 » Wed Jan 03, 2018 3:15 pm

Hello the good people of this educative and problem-solving forum. May I seek your indulgence to help with questions raised below?

Firstly, I have been married to an EU partner since 2014, precisely October. Wife has been working since 2014 till date and received my residence Card in 2017.When am I due for PR?

Secondly, my child was born in October, 2015 and currently use EU passport, when is she due for British passport?

Thirdly and lastly, I am very family oriented and would go any mile to keep my wife(EU origin) and child. The challenge has been that, my wife has attached herself with bad company of friends and has been influenced negatively. She used to be very calm, respectful, cool headed and loving but since the last 19months,I have seen HELL.I have been enduring emotional, physical, psychological, verbal and even facial abuse from the same woman. I do not want to share this with any of my close friends or family members as I fear, I would be coerced to doing what I never wanted to (physical attack or divorce).I overheard her on the phone talking to her friend threatening more physical attacks on me this new year of 2018.This really got me worried, I pay bills as at when due and take good care of her and my child but I just realised none of my goodwill has been appreciated in anyway.

Since I wouldn’t want to run fowl of the law or be thrown behind bars and ofcourse,I dont want divorce but if it is the only solution (divorce),I wouldn’t mind at this point. I am suffering from all sorts of abuses from her even in presence of my little child, she tag me a monkey and threw bananas at me.I was thinking of reporting this to the Police as I have some videos and audios secretly recorded during one of her reign of physical assaults at me. have tried to seek refuge in one of her good god-sister and begged to see how she could talk her through at least to change for the good because of the child between us but all to no avail.

How do I draw the authority's attention to this? Please, the good people help a frustrated and depressed brother.

Thank you.

I will try to explain what you need to do and also alert you with some implications ahead.

1,Your question.
When am I due for PR?

Answer to that is if you get married in UK and you can demonstrate that your EU wife was working as you've said for complete 5yrs from that date or month then you can apply on your 5th year of that marriage. Either you stay together or not,as long as you're still legally married. Otherwise you need to proof from anytime either after/before marriage or start date of your resident card.

The implication on this!
You will need all her employments proofs for 5yrs, ID/passport with her proof of address to be successful with PR. But if this row continue you may get stuck if you're unable to provide them.

2, Your question.
when is she due for British passport?

Answer to this is your child is still very small but my advise to you is to create a very very strong bond with her as that will eventually help at a later stage. But to your question, she will never become BC without anyone of you both parents having PR. Unless she will have to complete 5yrs resident in UK with extra 1year total 6yrs to apply for the BC in her own right as an EU citizen.

This option will work well for you if you think you can continue to manage the relationship till that time.

As per the domestic abuse. Read this attached regulation 10 you will see where you fall into at large.

Most importantly, you will need to proof everything you've pointed out and you need to report to the police with crime reference log number. Also the proof may involve pictures, texts,e mails and even witnesses that can write to that effect and ready to include their ID and proof of UK addresses. Then you may give it ago at anytime. However you will still need to proof her employments paperwork uptil the time the domestic issue kicked inn.

Good luck.
It is really good to help and everyone deserve to be respected in life. Good luck.
