Tier 4 visa holder applying for residence card as spouse of EEA national

Post by Oneiros » Thu Jan 04, 2018 11:16 am

Hello,

I am a Trinidad and Tobago national in the UK on a Tier 4 visa. My fiancée is an EEA national with permanent right of residence in the UK. We are getting married shortly, and will submit my application for a residence card as soon as we do. However, my current visa expires about a week after our marriage. My question therefore is, the fact of my married status conferring rights on me notwithstanding, will I be in breach of immigration laws when my visa ends? Would I be liable to be removed? (As a citizen of Trinidad and Tobago I am allowed to visit the UK visa free, if that makes a difference.)

Any guidance would be appreciated.

I think you will be fine if your marriage take place before your visa expires.
