3rd Party Funding from Overseas

3rd Party Funding from Overseas

Hi All,

My query is regarding the 3rd Party funding from Overseas during the initial application. I have applied for visa with 3rd Party funding from overseas but my visa got refused and I went into appeal and appeal got approved at last. It took 15 months from initial application ( Initial + Appeal Time) to get the visa.
But The problem is that during that appeal time the 3rd Party investor changed his mind due to the uncertainty and he was not willing to pay the money anymore. I have chased him for 2 years now but its no vein. I have now invested 25K in the business account from personal account through savings. My uncle is willing to invest the remaining 25k from overseas to my personal account.
My question to the senior members is that as per above information will it be ok for extension application or could I face any problem. My company was loss for first year and profit in the 2nd year. I have got 11 months left in the extension.

It is unlikely you will be in trouble due to this. There is no requirement that you need to use the same source of funding.

Having said that, there is a requirement that you should have maintained access to the funds until it was invested, which is something you have not done. Haven't seen any cases where HO has actually asked for evidence of that or checked that, so unlikely they will start with you. The key is to do all the documentation properly so HO does not need to ask more questions.

Stick to the guidance document - provide all the documents they require and don't keep adding documents that are not specified. Organise the documents properly so it is clear to the CW what documents you have provided and why.

At the top of this Forum, you will see an example of an application that may help you.

Hi marcnath,

I have applied for Tier 1 Entrepreneur in July 2014 but got refused and got the visa in Oct 2015 after appeal won.
Will I be eligible for ILR IN June 2019 Or in Sep 2020?
