Tier 1 entrepreneur Visa - partner Issue

Tier 1 entrepreneur Visa - partner Issue

Respected seniors/moderators,

I have got my extension approved 9/11/2017. Applied in a team 50k. Partner went on 10 yrz route and got his indefinite approved. Before all the company related issues and contracts and expenses were shared now partner not taking part and not putting in time and sharing expenses. I need yours opinion that what should I do and how can I get rid of him from the company as we both 50% shareholders yet the company contracts and expenses all on me. All the clients we have is because of my effort and they doing business with me. My questions are:
1) how can I get rid of him.
2)as we shared the investment If I go on ILR what things I need to do. Do.I have to.invest £50k or £25k again.
3) Intial 3 yrs we applied as team and extension was granted as a team. If I go for the ILR will this have any impact on my application as It will be a sole application and not as a team.
4)legally partner is bound to share 50% of the company expenses as He is not putting in any efforts and my hands are tied what should I do.

1) and 4) have nothing to do with immigration. I empathise with your situation but it is a legal matter between you and your partner and what legal agreements you had. If you had no legal arrangements and the client relationships are with you, then it should be easy enough to set up your own company and move customers and suppliers to the new one. But talk to a lawyer.
2) You don't have to do anything. Your investment has been approved, so there is no need to provide any investment evidence at ILR
3) No, there should be no impact.

You have failed to protect yourself legally and financially as you jumped in the business with a partner who was interested only in the visa. You should've drawn clear agreements to made sure that a partner who stops contributing will lose his/her stakes in the company and can be removed from directorship soon after. This is not an immigration issue in general so please seek legal advice asap.

Thanks Marc and Zimba.

Basically I am very much annoyed from him. He basically used my friendship I shared 35k in investment and he only had 15k and He just did not even bothered to tell me before going to Ilr and once He received his Ilr on 10 years He stopped all the sharing in the conpany expenses. He was never an active person in getting contracts. I AGREE with zimba there is no place of trust left now on any1 paperwork should have been done. Now my questions is I am paying all the expenses and I have evidences of these so how can I put pressure on him to share or get rid of him basically He still wants to be in the company as He has applied FLR for his wife and still not received my hands are tied. I dont want any money from him just need a way to get rid of him.

You need to take legal advice.

But in general, there is very little that you can do other than move all your business to another company as soon as possible. As long as you are in this situation, he has the rights to 50% of any profits in addition to all the benefits he has already got.

You are just creating more legal problems for yourself if you continue with out a proper legal advice.
