Will I be rejected because traffic offences

Post by Winston522 » Sun Jan 07, 2018 7:54 am

Hi guys

I am a final year student in the UK. 25 July 2017, I received three traffic offences: drive without valid license, no insurance and no MOT test.

I plan to fit her my study in master degree in the Uk. And I received some offers from the UK’s universities. I need to apply for another tier4 for masters on July 2018.

But I am so worry about my tier4 visa for masters. It is clear to me that I have to declear above offences or I will be rejected automatically. So I decide to declare them.

At this stage, I urgently to know wheather my visa application will be rejected due to above traffic offences or not. Please!

Best,
Caolen

Traffic offences

Post by Winston522 » Sun Jan 07, 2018 8:00 am

Hi guys

I need to apply for tier4 visa for master on around July 2018. Currently I am a undergraduate student in the UK.

I have three traffic offences in July 2017, driving without valid licence, no insurance and no MOT test. I am so worry about will these convictions affect my application or not. It is really important to me! And I really feel sorry about what I have done. I fixed them and everything with me is legal now!

I really need your help on it!

Best
Winston

Assuming you are applying in the UK, they will have no effect. If you are applying in your home country less than 12 months after the last offence, they will be a discretionary (not mandatory) ground for refusal.

You can check the General Grounds for Refusal for both entry clearance and leave to remain, both of which are split into mandatory and discretionary refusals:
https://www.gov.uk/government/collectio ... d-guidance

However, as a university student you have free dedicated immigration advice from your Tier 4 sponsor. If you are not satisfied with my answer and the above guidance, I advise you consult the international student adviser there about your concerns.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Really thanks for your reply. It is helpful!

So you mean basically I have to apply for the visa in the UK. Why I will be refused if I apply for the visa in my home country? I received the offences on 25 July 2017, so if I apply for the visa after 26 July 2018, everything will be fine ?

Winston

12 months from 25 July 2017 is 24 July 2018.

Thanks for that.

But can I apply for a new visa for masters in the UK or I have to go back to my home country to get one? Coz most of my friends they go back to home country to apply for the new visa.

Many thanks
Winston

Or as I said in my first reply, speak to the international student adviser. I am not clear why you are relying on this online forum when you have access to free and dedicated immigration advice at your university.
