Is it possible to switch from YMV to FLR (M)/ Fiance Visa?

Post by hopeelisa » Mon Jan 08, 2018 5:33 pm

I'm wondering if anyone could advise as to whether it is possible to apply and switch to the Family (Fiance) visa from the Tier 5 Youth Mobility Visa, from within the UK without having to return to my home country (Australia).

I'm aware that it's possible to apply for the full FLR (M) visa from the YMV. However due to minimum notice for intention to marry, we're not sure we would be able to marry and apply the the full FLR (M) visa before my current YMV expires.

Therefore we see the fiance visa as a stop gap to give a little more time to stay in the country and lodge our notice of intention to marry and then marry.

Any advice would be so greatly appreciated.

A fiance visa application can only be submitted from outside of the UK.

You could of course return to Australia and submit the fiance visa from there, which would enable you to return to the UK, marry within 6 months and switch to FLR(M) before the expiry date.

Thank you for your reply. Can you point me towards any documentation that indicates this?

"If you’re outside the UK
You can apply for a family visa to live with your:
spouse or partner
fiancé, fiancée or proposed civil partner
child
parent
relative who’ll provide long-term care for you"

https://www.gov.uk/uk-family-visa

A fiance visa is a 6 month ENTRY visa.

In order to switch to FLR(M)
You must be able to prove one of the following:
you’re in a civil partnership or marriage that’s recognised in the UK
you’ve been living together in a relationship for at least 2 years when you apply
you are a fiancé, fiancée or proposed civil partner and will marry or enter into a civil partnership in the UK within 6 months of arriving
