Tier 2 to ILR

Hello Everyone,

I will applying for ILR after being 5years in Tier 2 general.

My first Tier 2 General was issued(switched from PSW) on 07/04/2013 and expires by July 2018.

I will applying for my ILR on 12th March 2018(based on 28 days prior route).

My current salary is 35,600 at 40 hours/week. I have paid more than Experienced SOC 2136 rate which is 32,000, so that's not an issue.

The question is,

1. Is that minimum income threshold of 35,000 based on 39 hours per week?
2. If yes to question 1, Should I earn 35,000*(40/39) = £35897.43 for 40 hours to qualify for ILR income requirement?

Salary requirement for ILR is the gross salary not pro rated. So if your gross salary > £35K then you can apply

If I am right, the income threshold 35,000 doesn't care about hours worked per week.(39 or 40 hrs.)

In my case, I earn 35,600 at 40hrs assuming I am eligible for ILR?

Yes as I said hours don't matter its the gross salary .
