Spouse ILR application

Hello everyone,

I need some guidance for my wife's ILR application.

I have been living in the UK for over 5 years on a Tier 1 General with my wife. I received my ILR over a year ago. My wife is now eligible for ILR (and meets the requirements) but I am currently not working.

I have received conflicting advice. One immigration solicitor indicated that I need to be economically active at the time of my wife's application. Another immigration solicitor said that my economic activity is irrelevant and I do not need to be employed.

Can anyone help and let me know if I need to be employed at the time of my wife's application? Can you also point me to where it says this in the guidance notes?

If she is a PBS dependant, then see also 319E. There doesn't seem to be any requirements regarding your employment.
