Illegal stayer marrying EU national

Post by sidd12345 » Thu Jan 11, 2018 6:30 pm

Hi Sir,
Recently my company terminated me from tier-2 sponsorship and now i became illegal stayer in the UK since october 2017. In December I met a girl came from Romania and we are in love and want to start a relationship. She is 20 now so basic pay for her is £5.90. Its not even been a month since she came to the UK from romania and its her first time visit to the UK. Can we prove the UKBA that we are intended to live together in the UK and obtain a EEA family visa? Thank you

In order to marry in the UK you will have to give notice at a Home Office designated Registry Office. The Registrar is then legally bound to notify the HO, who can then extend the notification period from 28 to 70 days in order to interview you both separately before the wedding can go ahead, should they choose to do so.

As you have no legal status in the UK you are at risk of being detained during the interview. If your girlfriend has only been in the UK for less than a month, you'll have a tough challenge to convince the HO that your relationship is genuine and not simply an attempt for you to remain here.
