Retention of right of residence

Post by Ishjon » Fri Jan 12, 2018 7:08 pm

Dear forum members, I have a question on behalf of my cousin. He is an eea family member who is process of divorce. Married on March 2014, divorce filed in July 2017. He has received letter from court that the judge is happy with the reasons for divorce and the date is set for pronouncement. My question is after he gets decree nisee he needs to wait 6 weeks to apply for decree absolute, he has a holiday booke so if decree absolute is issued whilst he is abroad on holiday, will this cause any issues in terms of retaining right of residence as I read somewhere that the person must be in the uk on the day of divorce. I would appreciate of you can share your knowledge on this issue.

Thanks
