Hello can someone help please.my sister have been with her british partner for 3 years and apply to home office as efm of partner daughter who is Irish you is working in the uk they all leave in the same address. Her application was put in in July and my sister married sponsor father in October and sent the marriage certificate to ukba later.note my sister have no visa to stay in uk.in November ukba refused her application due to no evidence of dependency. Though the home said she is accepted as efm and gave her permission to marry knowing she have no stay do you think JR can help.please help betty

Does not make sense. How old is the Irish Citizen and what is he or she doing in the UK

Hello oboe not very good with computers. The Irish national was 21 when my sister put the application and she is working in the uk full time and her dad my sister married is working too they have been living inn the same household for over 3years now which my sister can prove.the refusal letter also said she can't appeal that was why the judicial review came up .thanks for your reply obie

There was no need for JR. A notice of appeal could have been filed.

Stepparent are direct descendant in the ascending line. They are not extended family member and therefore there should have been a right of appeal.

Thanks for your prompt reply obie she was not married to her when she put her application in .obie please do you think judicial review will help as her solicitor have started the process already and can my sister be removed from the uk ? Thanks again
