Employee on maternity leave

Employee on maternity leave

HI
Need ur help as m confused with one issue.
I have applied for my t1 entrepreneur extension on 18/12/17, I showed 1 full time and 2 part time employee. One of the employees went for a unpaid maternity leave as she was not qualifying for a paid maternity leave. She came back after 2 months.
My concern is that whether this period be counted in job or not.
Plz guide with your knowledge and comments

Good question - it is not defined in the rules.

But given that the way HO calculates hours as pay/hourly rate, I would say it won't be counted. They would see it as zero hours in those two months and you would not get credit for those.

That employee work for 2 months and went for maternity and worked for 10 months till I applied my extension.
Let’s say if Ho didn’t consider that maternity period then this way is it possible to cover or not. Plz guide

If she worked for 2 months, took leave and then came back and worked for another 10 months, then the job creation requirement of 12 months is satisfied.

Yes thts the case but I have submitted her maternity docs as well if CW consider tht docs only and don’t calculate the other 10 or see it as break then

There is no requirement that a job has to be continuous. Even if she was away on two months unpaid holiday, it would not have mattered. You only need the 12 months in total.
