EEA2 Unmarried non EU partner,Any HELP will be appreciated

Post by Jimmybones100 » Mon Sep 19, 2016 8:48 pm

Hello Gents,
I am ex British army,an overstayer and I applied through a solicitor for unmarried partner RC card early February, received biometrics letter and COA together on 28th march, did biometrics on 3rd of march.
On 8th of august my solicitor received a package with my partners passport and few of the stuff we sent.My solicitor who has been so useless sat on it till month end august when I contacted her about the application. She didn't tell me they received the package 4 weeks earlier so I called HO who told me a package was sent with a decision on 3rd of august whichmy solicitor only received on the 8th of august with the passport and a few bills. She called them and they confirmed a decision has been made.
She has since sent 2 letters now, asking for the decision to be sent to her but still nothing.
It's been now over the 6 months allowed, and despite the decision made long time ago they don't want to send it to us.
Guys any help will be appreciated,my solicitor is useless,I have learnt more reading from this forum and chasing it up myself really, what can I do ?
Thanks in advance.

That is strange.

Did you establish if the decision is adverse.

It must have been, or else a Biometric Residence Permit would have followed.

They refused to give me or my solicitor the decision the phone, hence telling us to write to their Liverpool office which my solicitor has done twice now,2 weeks ago and today.

That is incompetence at the highest degree.

It is likely to be an adverse decision, otherwise your passport will have been returned, and a Biometric residence permit will have been issued.

I guess it is now left to you to get the decision.

I hope not cause it's been a long and stressful wait, especially knowing they made a decision long time ago and forgot to put in the package and now they can't even just seen it to us
