ILR 5 year calculation period start date

Post by jakky88 » Tue Jan 16, 2018 4:56 pm

Hi,

I switched from PSW to Tier 2 general back in Dec 2013. (Working for the same employer)

I was granted Tier 2 General visa on 15th Dec 2013. My Cos start date on the application was however 24th February 2014.

While calculating the 5 year continuous period for ILR, should I calculate from the date of grant of Tier 2 General visa (15th Dec 2013) or would it be the COS start date?

It is 5 years of lawful stay, so it will be from the grant of visa, not CoS date. Of course, I assume you were not actually working until CoS date
