Hi,

I am in the UK on the basis of my Father being an EEA national (Spanish) and i have the visa stating "Family member of an EEA national" valid until 2019, after which i will be eligible to apply for ILR.

I am married to a pakistani national residing in pakistan. Is it possible for me to sponsor my Spouse to join me in the UK? I have been told that since i am already a dependant of my father, I cannot sponsor someone else to join me.

Some advise will be highly appreciated.

Family members of EEA citizens cannot sponsor other family members. Only the EEA citizen himself/herself can sponsor either their family members (defined as spouse, descendants under 21, dependent descendants over 21 and dependent ascendants) or extended family members (family members who are dependent on the EEA citizen or those who lived with him/her in their country of origin).

What nationalities do you have? Did your wife live with the EEA citizen in their country of origin? Or is she financially dependent on your EEA citizen father?

In any case, your wife will be an Extended Family Member (of your EEA citizen father) and will have no right to reside in the UK until she is issued a Family Permit or Residence Card by the Home Office.

Thank you for your prompt reply. My wife did not live in the country of origin however, she is financially dependant on my father as he is the breadwinner of the family. Me and my spouse are Pakistani nationals (Non-EEA).
