ILR - For Dependent

Post by gsinha » Mon Jan 22, 2018 11:54 pm

Hi Friends,
I need some suggestions on my wife's ILR application. We are not quite sure if we satisfy the following criteria

You must also have been living with your partner in the UK for at least:
2 years if you applied for your current visa before 9 July 2012
5 years if you applied for your current visa on or after 9 July 2012

Below are the key dates
a) Date on which the first Tier 1 Dependent Visa was granted - 16 Apr 2013 valied up to 14 April 2015
b) Date she entered the UK - 28 Apr 2013
c) Tier 1 Extension - 21 mar 2015 ( within 28 days of the visa expiry i.e 14 April 2015) and visa valid up to 21 Mar 2018.

We want to now apply for ILR but we are not sure if wwe satisfy the 5 year cohabitation criteria. Has anybody faced such a problem before?

Thanks in Advance
Gaurav

Applying for an extension too early shorten her time period to apply for ILR. She may apply for ILR under 319E from Monday, 19 March 2018 and before her leave expires, subject to your ILR being granted under PBS.
