I need you’re an opinion before I decide to speak to a solicitor.
I applied for UK naturalisation in June 2017 and fingerprints taken within 2 weeks of the application. In September 2017, I got a police caution for an argument with someone. In December 2017 when I was back home to resolve the family issues Home Office sent me letter and rejected my naturalisation application because of the police caution. I’m ok with this decision as I did not fulfill the criteria of good character.
However, they also mentioned on the letter that as I did not update them about the police caution they will put this on my record and if I apply any application again in the next 10 years it is going to be rejected.
I had no intention of hiding about this police caution from Home Office as I knew they will find out about it automatically and will reject my application based on good character due to the police caution and I won’t be able to apply again for the naturalisation for another 3 years.
During the period from Aug until now, I had so much going on in my personal life as I was trying to work on my marriage issues and issues with the family back home (went back home in November for few days and again in December for 2 weeks to resolve the issues). I got so busy with these things that I forgot to update Home Office about the police caution.
I’m thinking to send Form NR to Home Office and ask them to consider the decision again and let me apply for citizenship again in 3 years which is the time limit for police caution. Does anyone think if the Home Office will remove this 10 years ban from my record based on issues that I was facing at that time. I have been in UK for the last 11 years and have lived here abiding the laws and never even had a parking ticket issued to me.
I would really appreciate if the community can help me with their experience and let me know what can I do for Home Office to remove the 10 years ban from my record. Is it worth to hire a solicitor and send Form NR through them to reconsider the decision for 10 years ban. I got ILR last year through Tier 1 General basis and my wife is British born but didn’t apply the spouse visa.
Please also if someone can let me know if there is any time limit to send the Form NR.
