British Naturalisation with absences in excess of 1000days

Post by girlwithabsences » Wed Jan 24, 2018 1:04 pm

Hello

I am a resident of UK since 2008,I have been settled here with my family for 10 years. i acquired ILR in March 2013 with my family, as a dependent of my father as at the time i was in full time education in high school.
In Sept 2013 i went to Italy to study medicine as i couldn't get into uni in UK for medicine. Because of this i could not apply for naturalisation in March 2014 with the rest of my family as i did not meet the 9 months criteria in the final year for applying for naturalisation. I have been staying in italy for more than 6 months in every year following and at all the other times i am in the UK. I was thinking of applying for naturalisation in 2020 after returning from Italy in 2019 at the end of my course and living in UK for a full year. However i recently found out that since i am a non-EU citizen i will have to write several exams to start working in the uk as a doctor and hence lose a year or so. if i have a British passport this problem may not arise. so i was thinking of applying for naturalisation now in Feb 2018.
But i have a total absences of 1001 days in the 5 year period and 173 days in the past year. Do you think there is any chance of my application being accepted under discretion?

My family has been settled here for 10 years, my only home is in the uk and my family are all british citizens, i am in full time education hence a dependent of my father, i have always been travelling back and forth between UK and italy, i have been to India my home country only twice in the past 10 years so my main home is in the uk only. Also i intend to have my future here in UK.

i have consulted a couple of solicitors about this matter and they have advised that there is a chance of my application being accepted as i am still a dependent in full time education and i have absences just for study purposes and also because my principal home is in the UK....

anybody here have experience of or heard of anyone applying with absences of more than 900 days in the past 5 years and 90 days in the past year and been accepted?? if yes can you please give some info that is helpful

There are specific rules on how discretion is handled. The exercise of discretion is not entirely discretionary.

Have a read of Pages 16 & 17 of the Nationality Guidance for Home Office caseworkers. I would say that the chances of you getting naturalisation with such extensive absences are vanishingly small.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

thanks for your advice. i have read the document previously, it talks about discretion if principal home is in the UK and if absences were due to studies abroad on pg 27&28, so i was wondering if they would be willing to excuse an absence as big as 1000 days due to these other conditions and also if there is any benefit in going for it through a solicitor? or is it better that i comeback and wait a couple of years and then apply???

Hi. I'm in a similar situation to you. I was wondering what decision you took regarding applying now vs applying later after you've cleared your absences? And what happened to your application if you applied in february? Thanks
