Post by olivia101t » Sun Jan 28, 2018 1:27 pm

Hi everyone, my ILR is due on the 28th February and i am looking to apply for my ILR on the 17th feb, my wife just had a child and she is taking benefit at the moment from government, would this affect my application?

secondly i am working part time, what is the financial requirement for me and my partner, bare in mind i collected the 2 x 30months with £18,600 from my wife

When where you first granted your DLR? If you could provide the date please.

Also, if you where granted DLR before the 9 July 2012 immigration rule changes, you would have to complete 72 months and if after that time you would not be granted DLR but rather it would be leave to remain that would come under the appendix FM rules and it is a 10 year continuous period in which works out at 120 months.

It seems you have only completed 5 years?

Also is your wife of settled status (ILR) or a BC?

If you are on the 6 year or 10 year route you won't have the financial requirements if £18,600 to fulfill but rather some sort of maintenance may be applicable.

Dear CMOSUK,

thank you for your post/comment, i am slightly new to this forum and don't know what information to give, however to answer your question, I was granted months Further leave to remain on the 30th March 2013, i got married to my wife who is settle and British born on the July 2012, I believe i am under 60 months route as it was stated on my bio-metric letter sent to me....My wife works full time for NHS but was off work for Dec 2016-Dec 2017,almost 1yr due to her health , so her monthly wages reduced after after 6 months, Now my question again is that, will her reduced salary during the 6months that NHS doesn't pay for affect my application, How much do i need to earn to make the £18,600/yr, Moreover my bank account got closed for some weird reason and I've only used a prepaid account, is this acceptable to home office? thanks

Again you will have to confirm what visa was given to you, by the sounds of it, FLR (M) as you are married to a British citizen on a 5 year route to settlement, with the requirements?

You or your wife or combined should be earning £18,600 or 6 months preceeding the application for ILR £1550 per month equalling or over £18,600 if you cant provide for the full 12 months.
