Post by Hassan7861 » Mon Jan 29, 2018 2:03 am

Hi Admi and fellow members i have a small question i would be really thankful to you guys if u help me with my confussion.
I have recently been granted ILR on long residence basis . But it was refused before because of a small Gap on 62 days in my previous Applications so i appeald and my appeal was allowed and i was granted ILR. The Gap was in 2011 due to non payment of fee my application was rejected but later it was granted. Cut the long story short i just want to ask if i apply for british citizenship in january 2018 when im eligible for it . Will home office refuse my BC again due to this small gap. Or they will look at last 5 years for a gap. Im very confused please any1 help me with thjs confusion.
Thanks

It may depend on the basis of your successful appeal.

It may depend on the basis of winning your appeal.
In the Appeal judge said that the gap was also caused by the home office as they retained my documents for too long. And she said that home office failed to exercise their discreation and sbe allowed the appeal on human rights grounds. I applied my visa 3 months before my leave expire but the fee was declined and home office never wrote me letter abt it and kept my documents for 3 months and only sent it back after my visa expired in the mean time i had moved to different address and took me over 28 days to sort out everything and reapplied again.

You may have a good chance, if you included a copy of your appeal determination with the naturalisation application.

Don't forget if you are not the spouse or civil partner of a British citizen, then you must wait a year after ILR.
