child born abroad - UK citizenship - EU parents with PR

Post by liv » Thu Feb 01, 2018 9:00 pm

Hello.

I'm hoping someone can offer an opinion on this. We're a family of 3 - all EU citizens. Our child was born outside of the UK in 2008. At the beginning of 2011 we moved to the UK and have all been living and working here continuously since. At the end of 2016 we got our permanent resident cards for all the three of us, including our child.

Now, we would prefer not to apply for citizenship for ourselves (for the parents), but we'd like our child to become a British citizen. However, I understand that our child does not have an automatic entitlement to citizenship.

What are the chances for an MN1 section 3(1) application at discretion to be approved - if we decide not to apply for citizenship ourselves? Is that even possible? The MN1 guide says something like "one parent settled and one applying/being British" in order for the application to succeed. Is there any flexibility on that?

If there is no flexibility, what are the chances if only one parent naturalises in order to help the child's case? Or do we both need to naturalise since we're a family?

Thank you.
