Post by shaz79 » Wed Mar 19, 2008 7:08 pm

Hi everyone,

I'm currently under student visa and will expiry end of this month. I made an appointment at peo Liverpool next week. My concern is sometimes I do work more than 20 hours and now am worried that they might not want to extend my visa because of this.

I assume you already have the application form and are aware of Q6.3, which asks if you have worked, and if so, how many hours per week during term-time. You are also required to produce 3 months' pay slips relating to term-time work.
If your payslips do indicate obvious regular hours in excess of 20, you are indeed in danger of being refused. If that's the case you only have yourself to blame for breaking the law.
If it's irregular small amounts of excess working, they may not notice, or choose to ignore it.
If you lie on your application, you are not only in danger of being refused (or served with papers and removed if the deception is discovered later on), you could also be prosecuted.

hi,

thank you for your reply. i have all my documents and application form ready.

my situation is like this:

my pay slip is on weekly basis. so i will submit 12 pay slips from december till february. in december i worked more than 20 hours for 3 weeks because it was on holiday(so i am not worried). in january i worked max 20 hours, however, in february i did work 25 hours for 2 consecutive weeks, thats is why i am worried now.

on top of that my progress report is relatively good (am currently doing ACCA course) , and previously i did Msc in Finance and Business Management in University of Luton, and received a good results.

Do u think that when i go to PEO liverpool next week, they will not take so much notice of my working hours since i am a genuine student with good results and fairly good attendance?

thank you for time reading my post.

Quite honestly, I don't know. Common sense suggests that in those circumstances they would ignore it, but you can't be sure of that. If you are attending in person and have in your pocket payslips over a much longer period which show that you worked 20 hours or less most of the time, you could produce them if they queried it and argue that it's an insignificant breach.
Of course, if you've regularly worked extra hours, then you have a problem....
