Discretionary leave and settlement

Post by lisa_1630 » Fri Feb 02, 2018 4:22 pm

I have discretionary leave running out this year in April. I have had it for 5 yrs now after failed asylum.I still have 5 years to go. Now I have a British child who has British passport.I want to deviate/switch from DL to ILR because I am the sole carer for my son and his best interests . I am the one who lives with him and claim his benefits.Myself and the father we are not together. What are my chances of getting this?I have been living in UK for 17 years. Also if my dl is extended it will run until 2021 when I would have passed 20 years in UK.What are your suggestions?

May i ask for your full immigration history.

It will be slightly hard to give advice based on that info, as you are stating you have lived in the UK for 17 years, are those 17 years if (5 years of it will be) legal continuous stay? or has there been, at any point, a break in that continuous stay?

mostly likely if you where granted DLR in 2013 you may have to complete it for another 5 years (0 years) before being eligible to apply for ILR.
These are my 'views' and 'opinions'.
If in doubt always seek professional advice, or at least do a search for the relevant information. :P

If i make any mistakes, You are more than welcome to correct me.
