ILR (SET-O) Application from Ancestry Visa - Employment

Post by uniquecase » Mon Feb 05, 2018 9:04 pm

Hi All ..

I was hoping that someone could perhaps provide me with some information regarding my own situation. I am from New Zealand and my ancestry visa is about to run out in the next 2 months. I printed and completed all the documents (SET-O to apply for ILR, however, I am now feeling a little concerned as to whether I will be meeting the employment criteria set out as part of this application.

My situation. I am a qualified teacher, however, for the past few years I have not been teaching at all due to the demands of raising two young children, with the youngest who was born just over 2 years ago. I do however have an active, part-time role in my husband's (a naturalised British citizen) private Ltd. Company, from which I am earning both dividends and a small monthly salary. I have also just received a PAYEE tax bill in my name that I am about to settle, which is for the past year (2017). I am also currently waiting on a nursery place for our youngest son in order to go back to teaching once this may be possible.

I guess my husband and I are just not sure if the immigration officer will accept my employment status through a company that is owned by my husband, as they may view this a conflict of interest? My involvement in this company has also only really been for the past year, and not for 5 years as I believe is required for this application? I admit that we find it difficult to understand exactly what the requirements are in this regard.

The alternative would be to explore applying under the spouse visa, but thought perhaps it was worth asking here before we changed our plans (as we already booked the appointment).

Many Thanks
Sarah
