Hi All!

I started this topic on behalf of a relative who is an Indian national.

She applied for ILR in 2016 under 10 year long residency route. It was refused by UKVI. As she was on tier 2 visa she couldnt go for appeal. She then consulted a solicitor who recommended she go for JR with upper tribunal. A JR was filed on her behalf. The JR was refused. Then she went for oral consideration last year and in October Upper tribunal gave decision in her favour. UKVI didnt appeal against verdict [within stipulated time]. Now almost 4 months have passed since court verdict but UKVI has not sent any letter till date nor sent any letter for BRP enrolment.

My relative is worried. She was under impression she would get her ILR within a short span of time of winning the JR but now that more than 4 months have passed and no letter from UKVI she wants to know what she could do at this point of time? Is it normal procedure for UKVI to take more than 4 months to grant her ilr even after she won the JR [and UKVI not appealing either]. Can she contact them to enquire about it or will this not be a wise decision?

Did she win an oral permission hearing or a full hearing following a permission hearing? If it was permission hearing, then she should have paid fees to UT to take case further and UT would have arranged a full hearing. In that case, Home Office is not obliged to take any action until the full hearing. If she wins the full hearing, then Home Office can reconsider or still appeal the decision.

What was the reason for refusal?
