Curtailment Questions

Hello

I recently resigned from my Employer Sponsored Tier 2 General role and finish at the end of March. I understand my employer will inform the Home Office once I have left the company and I will then be issued a curtailment letter which may take some time to arrive. I understand the 60 days curtailment specified in the letter once received is 60 days from the date of the letter.

As such, can I please check:

1) Once I have finished my last day with my Employer, can I still stay in UK for a few more weeks on my Tier 2 General Visa? ie. I don't plan to fly back home for another 2 or 3 weeks after I have finished employment - would I be in breach of anything? If the curtailment letter is not received during this time, do my existing Visa terms still stand?

2) Will a curtailment letter still be issued if I have left the UK (and I have not received one while I was still in the UK)?

Hi,

I was in a similar situation.

1. No, you do not breach any immigration law whilst your stay after your employment. The issuing of the curtailment letter can take even up to 8 months and hence, you do not break any law.

2. Once you leave the UK, the home office is intimated of your departure and hence, the curtailment letter will not be issued in this case.
