Dear moderators , senior Gurus and friends thank you for information in this wonderful website helping thousands like me . My problem is , I had a EEA document registration certificate then in July 2013 my non EEA wife and child came to Uk with EEA family permit issued in March 2013 . In December 2013 they got EEA family residence permit valid till December 2019 . In March 2014 I got DCPR and started receiving child benefit for my non EEA Child and still I am receiving it . In January 2016 I became naturalised British citizen. I am now dual natoinal EEA and British and came to know that I did stupid thing creating trouble myself for my non EEA wife and child but I see little hope after the ECJ judgement on Lounes case . I am so upset and regret what I did without knowingly . I am thinking that I should refund all the amount of child benefit that I received before applying their PR in December .

Why do you want to give up the child benefit. I see no legal basis for you wanting to do so.

Unluckyeea2, your wife and daughter can apply for permanent residence cards to confirm that they have permanent residence once they have been in the UK for 5 years, i.e. in July this year. They may prefer to apply for the new settled status directly instead - the process starts later this year.

Dear Obie thank you for kindly advice and valuable time .I am confused is that some people talking about child benefit is only for British child or child with IlR can claim, before IlR claiming any benefit (public money ) could lead to refusal of IlR application . Thank you .

People in your position are entitled to claim benefits, just like the people with ILR.

Dear Richard thank you for your valuable time and kindly advice . yes it is better to apply in july at least it will have more time than december because of Brexit in march 2019 . I am doing research and waiting more advice about my problem . I will keep udate . thank you .

Your family won't be applying for indefinite leave to remain. They'll be applying for recognition of their having achieved permanent residence, or applying directly for its replacement, a new kind of settled status.

Dear moderators ,senior Gurus and friend I am thinking to write a email or letter to European Commission that what will happen to dual EEA/uk citizens non EEA family memmbers (similar to Lounes) after BREXIT March 2019 because they are not included in Brexit withdrwal Agreement . It seems now Lounes cases people are going to end up in courts and time is short due to Brexit on the corner . If they were included in Brexit withdrwal Agreement then they would have time for courts . Please any advice is appreciated and I am grateful. Thank you .
