Do I qualify for SET (LR) ?

Post by Mrska » Sat Feb 10, 2018 5:30 pm

Hi,

I came into the UK in 2003 on a student visa and have been on visa since, never had a break.

2003~2008 Student
2008~2010 Student
2010~2013 Student
2013~2014 Student
2014~2016 Youth Mobility Scheme
2016~2019 Spouse Visa

I didn't apply for ILR before as I had left the country for too many days during 2003~2008.

My questions are:

I have dual natuonality, I have all my BNO passports from 2008. However, I only have my Chinese Hong Kong passport since 2011 to current (as HK took my old passport in when I renewed)
Do I still need to find all the Council Tax letters etc. for the years 2008~2011? As this would be very difficult.. I was only 11 when I first arrived and lived in a boarding school. My visas are always applied under my BNO nationality.

My second question is that my BRP for 2013~2014 was taken in when I applied for my Spouse Visa, I do not remember the exact date of the BRP, but I do have the BRP letter for the application.

Will the above cause any problems? As I could renew my spouse visa and then get the ILR in 2022... I don't want to risk being rejected in the future. At the same time, being on visas aren't easy to get jobs or mortgage ....

I would be so grateful for any advice.
Thank you for your help in advance

The only 'proof' that I used were my old passports to show residence when I applied for LR. As long as all entry and exit stamps are in your BNO passport and you can prove your dates of absence, seems like it's time to apply!

Good luck.

Thank you for your reply.
That's a relief to hear.

I have been doing some research and a lot of people are mentioning SAR.

Is it worth getting a SAR to get the exact valid period for my BRP date. (The one that was taken back by the Home Office)

Or does it not really matter that I know of the dates as long as I am certain that I never overstayed, and never had a gap in between my visas
