ILR After 6 years DL

Post by asadzareef89 » Sat Feb 10, 2018 10:02 pm

Hello

I previously wrote on this forum at the time of my DLR extension which was granted for further 3 years. I have since completed more than 6 years on DLR as first application was granted sep 2011 and second one till 7 jan 2018.

I have applied for ILR and paid via Bankers draft. Got an email saying they had received my application but after a week I got my form back where I had forgot to tick even though the rest of the section was filled. I sent that back next day so the application wasn't invalid. After 3 days I received an email for biometric reminder but the strange thing was I hadn't received the biometrics letter. I replied to the email and after 7 days I received the biometrics letter dated 29th Jan 2018.

The thing I'm concerned about is along with the biometrics letter i received a statement of additional grounds letter, I find this confusing as the HO hasn't said they have refused my application and all the information I can find is that this is normally issued after refusal and prior to deportation but recently many people are getting this along with their biometrics. Now the wording is extremely confusing saying I or representative should fill it in if required to do so but doesn't exactly state if I'm required to?

What I find horrifying is that there's a section to fill that says to give them a reason why I should be given right to appeal in the UK and not overseas? Is that an indication they intend to refuse me without right to appeal?

To give an idea of my case, I have 3 british kids, 8 years, 5 years and 3 years old. My wife is also a British citizen and I had 6 years DL following which I applied for ILR, originally I did overstay before my 1st DL for almost 3 years.

Now anyone who had received a similar letter can please explain what I should do? I honestly can't afford a lawyer as ILR fees alone have had extremely distressing effects on us.
