Hi there,

My partner is Indian, I am British. He was an overstayer and I didn't meet income req when we applied.

We applied under flrfp 3years ago when I was pregnant with our daughter. Application refused got to judicial review when home office reconsidered and granted his visa.

Now his 2.5year visa is up and we need to reapply I have a few questions.

Should we apply flrm or flrfp again? We now meet income and as far as I can tell this would only save us one application and would mean we have to get him to pass an English test? Also as I am self employed my income does vary but is above 18,500p/a.

Secondly, we have a holiday booked for a couple of days after his current visa expires. Home office website says application can only be submitted 28days beforehand and may take upto 8weeks - Does it generally take this long? Are we able to do anything to speed it up? I am aware we shouldn't have booked a holiday but it was a genuine mistake we didn't realise his visa was up.

Lastly, is there a chance home office can refuse our application and it all goes back to the beginning - I am terrified of being in the position we were 3 years ago especially with having a 2 year old daughter and the whole application is making me very anxious again.
