Urgent flr parent of a British citizen

Post by Chobaba » Tue Feb 13, 2018 11:10 pm

I got my first 2.5 yrs in 2015, during that period I was still with the mum of my child it went smoothly fast forward to now things have turned sour I haven't seen my son in six months bearing in mind I have a court order in place for contact but I just avoided her because she was really toxic and made several allegations against me and took me to family court for molestation.I pay child maintenance as Well,I went to the premium centre in Glasgow last Saturday to have my visa extended took with me every relevant document that I had like my son B.C,copy of his passport n red book ,the H.O official asked why I hadn't seen my son in 6months explained my situation he said he understood but I should make efforts to see my son because that's why I'm here in the first place he gave me two weeks to send him my efforts, well two weeks is almost up I have been back n forth with her solicitor I have proof of contact but it seems I'm hitting a brick wall also have recordings of me asking for my ex mother in law intervention as I always pick my son up from hers since I have been banned from my ex address or having any contact with her,she assured me she will help but today she's no longer picking my calls as the H.O official asked to see efforts can I send him screenshot and voice recordings of ex mother in law and my ex solicitor with proof of email sent.I'm really getting frustrated do ho accept voice recordings?

Your current spouse visa is expired or not yet ??
When did your ex wife take you to the family court ?
Have you asked the court for child arrangement order to see your son ?
That is what you need to do ask them for child arrangement order and that is what the home office needs.
I don't know if phone records is allowed in the UK.

What is your immigration status at the moment?

Iam in the same situation like you but I had a child arrangement order to see my son supervised in contact centre and I have a hearing soon for the court to decide if my ex allegation was true or not.

Good luck bro

My first visa was based on father of a British citizen, I have a court order which the home office has with then but because I haven't been in contact with my son for six months hence why he asked for additional documentation to prove I'm trying to see my son, only have an email and phone recordings I'm literally exhausted, hope your situation gets resolved

If you have a court order from before saying that you should have contact with your son why couldn't you see your son for 6 month and if your wife making difficult to see your son and the order saying so then it's not good for her.
The court can punish her for that.

When your visa will get expired ?
Do you have any hearing listed soon?

My situation is so complicated man
I think yours is easy and hopefully you will see your son soon.
Just try to prove that you contacted her solicitor , her mum asking about contact and that you are waiting for the court decision.and the court ordered before that you can have contact with your son and that you pay money for him.
Good luck

Have you made attempt to enforce the order within this 6 months. That would have proved that you have interest. Has CAFCASS been notified. Did you email her to notify her of actions you will take if she refuses to comply? The Home Office is correct that simply having a Court order does not entitle you to stay here, it needs to be shown you are playing an active role in the Child's upbringing, and you intend to continue doing so for the foreseeable future.

Well it has been a difficult six months especially when you have all sorts of allegations levelled at you the best thing to do at that point in time was to stay away while still paying for my child's upkeep, now is the right time to establish contact again and I will be calling cafcass today regarding my situation, home office asked me to provide proof of me trying to reestablish contact with my child, I have called and sent text messages to my ex partner mother also to her solicitor but everything is moving at snail pace but I'm upbeat and I will do everything I can. The time frame I was given by H.O ends on Saturday but my lawyer has asked for an extension because all I have got to show for my efforts right now are screenshot of call logs, text messages, email and voice recordings but don't think that night be enough or what do you think and my visa expires on the 1st of March 2018
