Hi,
I am a Turkish citizen. I worked and lived in the UK on a Tier 1 visa from 2010 to 2015. I got married to a Turkish man in Turkey hence returned to Turkey in 2015. I was heavily pregnant at the time and decided to give birth in Turkey as I was not eligible for ILR (exceeded 180 days outside the UK in one of the 12 months period in between 2010 and 2015). My daughter was born in Turkey in 2015.
I am returning to the UK for work on Tier2 visa and my daughter and my husband will be dependant on me. I decided I could stay for another 6 years in case I get citizenship for my child same time as I would do.
The problem is my husband will not move with me. He will probably extend his dependant visa in three years time but he will never live with us (he will do only short visits as he cant quit his job in Turkey) and hence wont be able to get ILR in the future.
I was wondering if my child could get ILR and then citizenship if I prove that I am the sole parent with all financial responsibility in 6 years time? Would I need to divorce my husband? Or what if I had the second child from my husband in the UK? Would home office seek for proof that I am not in contact with him and reject our application?
In the guidelines mentioned here:
https://www.gov.uk/guidance/immigration ... ly-members
Paragraph 297e it states that a child can get ILR if;
‘one parent is present and settled in the United Kingdom or being admitted on the same occasion for settlement and has had sole responsibility for the child’s upbringing;’
I understand my child may fall under this category but not clear if she can get a British passport afterwards? And what proof are they looking for?
Appreciate your help,
Thank you
