A second EEA Family Permit?

Post by RossFiore » Fri Feb 16, 2018 7:04 pm

Hello everyone,

I am reaching out to you for some help on my husband's UK work authorization.

I am EU citizen currently studying in UK, my husband is from US. He joined me in Sept in UK with a EEA entry family permit. He has since then been working here in UK. We were just contacted by his employer asking for a new visa or residence card in order for him to be able to continue working after his permit expires (in 2 weeks).

Unfortunately we have not yet applied for a residence card. Right now he will not be able to work during the Residence card processing time, which would take up to 3 months. This is the time frame before he receives application confirmation, which the employer accepts as proof to work here.

I was researching and trying to find a faster way and found out that he might just go back to US and apply for a new UK family entry permit for another 6 months, however I am not sure if this is possible, as he has already lived and worked here in UK. I called multiple places(US and UK gov) and no one was able to clarify this for me.

Would anyone be able to advise on our situation as we are now trying to figure out what is out best route.

Let me know if you have any questions.

Thanks a lot in advance!

A day trip to Calais for the two of you as soon as his family permit has expired would be better if his employer will accept an 'EEA regulations stamp', commonly referred to as a 'Code 1A stamp' because that is what used to be given. Note that he should receive this stamp when he passes UK Immigration at Calais. You may need to carry evidence of your continuing employment with you just in case he is suspected of trying to live in the UK by repeated re-entry on the basis of the initial right of residence.
