12 months ILR requirement for citizenship.

Hello all,

Would someone be able to advise on whether one most hold ILR for 12 months before applying for citizenship?

When going through the online application, this is what came up on the eligibility page towards the end:

Residence requirements
If you are the husband, wife, or civil partner of a British citizen, you must have been in the UK for the last 3 years. If you are not the husband, wife, or civil partner of a British citizen, you must have been in the UK for the last 5 years. This is called your ‘qualifying period’.

You must have been in the UK on the first day of your 3-year or 5-year qualifying period
You must not have spent more than 270 days outside the UK during a 3-year qualifying period, or 450 days during a 5-year qualifying period
You must not have been outside the UK for more than 90 days in the last 12 months
You must not have been here illegally in the 3-year or 5-year qualifying period

Meanwhile, on GOV.UK Information Page, it says this:

You can apply for British citizenship by naturalisation if:

you’re 18 or over
you’re of good character, for example, you don’t have a serious or recent criminal record, and you haven’t tried to deceive the Home Office or been involved in immigration offences in the last 10 years
you’ll continue to live in the UK
you’ve met the knowledge of English and life in the UK requirements
you meet the residency requirement
And you must usually have:

lived in the UK for at least the 5 years before the date of your application
spent no more than 450 days outside the UK during those 5 years
spent no more than 90 days outside the UK in the last 12 months
had settlement (‘indefinite leave to remain’) in the UK for the last 12 months if you’re from outside the European Economic Area (EEA)
had permanent residence status for the last 12 months if you’re a citizen of an EEA country - you need to provide a permanent residence document
not broken any immigration laws while in the UK

Secondly, if someone is married to a British citizen and has live here for say 10 years continuously, can that person apply for citizenship straight the same day ILR is granted?

Yes, if you are not the spouse or civil partner of a Brtish citizen.

Secondly, if someone is married to a British citizen and has live here for say 10 years continuously, can that person apply for citizenship straight the same day ILR is granted?

Yes.

Assuming all the other relevant requirements are met.
