Employees Working Hours and Time Sheet Sent for Extension

Post by tier1visaanil » Tue Feb 20, 2018 6:59 pm

Hello all,
I applied for extension on 06 January 2018. And have submitted the bio meterics. The complex letter was received on January 16th, 2018.

I had submitted the employee's time-sheet along with the payslips, RTI, FPS, P32, P45, P46 etc.

The Home Office requirement is 30 hours per week. In the month of December, due to holidays there is a week when the hours per week has fallen below 30. But the total hours in the month are 140 shown on the payslip and time sheet. I am worried if how HO will look at it.

It has happend in two more months where there was bank holidays, but in each month the total hours are above 140 per month.

Please suggest. ( I think, I should not have provided the time sheet). Should I withdraw application and resubmit again?

Assuming your visa has now expired if you withdraw, your fresh application will be an out of time application and subject to automatic refusal if your visa has expired 14 days back.
Yes, you should not have submitted all the unnecessary documents, but too late to worry about it.
You are right in that if the CW really goes through all the documents, they may disallow the three weeks you are short.
Are you saying you only submitted exactly 52 weeks for each job ? If you had another three weeks more, you don’t have an issue anyway.
Anyway, since you have more than 130 hours per month and assuming you pay monthly it should be ok.
Overall I think you are worrying unnecessarily

Thank you very much marcnath,
My visa expires on March 20, 2018. I have submitted only for 1 year.

I think, I will consider withdrawing the application. My next question is:
I had submitted the dependent along with the main applicant. If I withdraw the main applicant application, will they send the dependent application as well?

SINCe you are paying monthly so weekly calculations wont matter

But thats precisely the reason why submission of extra documents is discouraged

Anyway, from my experience, marcnath is an expert in Job creation requirement (may be he is expert in other domains as well which I am unaware of) so i would say follow him blindly

Thanks.
I did not pay fixed wages. To clarify, This is how how I did:
Job One: One employee- worked for 1 year each month more then 130 hours.

Job two: consists of two part time employees. Each month they worked for more then 130 hours( if i combined their hours together). BUT is one week in the Month of December (Christmas week) when their total hours were below 30 hours in one week but the whole month in December their work together is well more then 130 hours.
The same happend in two months when bank holidays fell.

We produce payslips monthly and pay them monthly only. But payslips have total hours worked in a month and per hour wages paid.

I assume the jobs have continued for more than 1 year. While I don’t think you have any problems you can just send in another months payslips and FPS just to cover off any shortfall.
It does not make sense to withdraw the application. In the absolute worst case if your application is rejected you can do a fresh application at that time
