Switch from EU Family Member to UK Partner visa

Hi all,
I have a Resident card as a family member of EU national. I am also marriage to a British citizen for two years now we have been living together for Three years, we have one Daughter.
My Brother was marriage to EU national through which I got my resident card. The relationship have ended with my Brother and the EU national.
I am kindly asking for advise, can I applied( switch) through my partner or can I applied as Parent under my Daughter?
