Retained Right of residence

Post by joseuk2014 » Thu Feb 22, 2018 3:54 am

Hi
My self was married to a French citizen since 2009 and came to UK from India in Aug 2014. I was holding the residence card valid until October 2019 We divorced mutually on September 2017. We have a daughter and the daughter is living with her in UK a and she is now studying and working in UK. She is still a French citizen. Based on my rights I applied for ROR on November 2017. I asked my ex wife for the documents like her Pay slip and P60 ,but she denied the same. She denied the same via email and SMS, I have the written proof in email from her which says thats she is not willing to give her payslip and P60 to me. My lawyer told that he has written the same in the case and submitted the application along with the other proofs like Rent agreement in mine and ex name,Utility bill,my Ex NI number details, her employment history with a scanned copy of her job contract, Letter from my daughters school, Our marriage certificate, Divorce certificate, My daughters birth certificate with original French and certified Translation, My ex passport copy, my pay slips and P60, Family photos, email communications, child maintenance details etc.
My confusion is that based on the above status what is the chance for getting Residence card. My right is that the marriage has lasted for more than 3 years and we lived together in UK for more than 1 year, to be precise 2 years before filing divorce .
Please help me with your experience. As I have not submitted my ex pay slips will Home office will check with HMRC for her economic status during that period.
