Child reentering UK with parents on ILR

Post by lodoes_awol » Thu Feb 22, 2018 8:04 pm

Hello, I'm in a panic as we have booked a holiday in two weeks time out of the UK and now I am confused if my 18 month old daughter will be allowed back into the UK.

We (both parents) have ILR, but we will be travelling on New Zealand passports as we have not applied for British Citizen (or naturalisation) yet. From what I understood my daughter who was born in the UK, but before we had ILR took on our status when we were issued ILR and I thought this was adequate for her to travel in and out of the UK. She will travel on a New Zealand passport as I have not applied for her British one yet due to the fees and was waiting until we had British Citizenship so then I could just apply for her to have a British passport.

My question is, given that we will all be travelling on New Zealand Passports with parents with UK ILR, is this sufficient, or was I meant to have applied for a separate visa for my UK born daughter to reenter the UK?

If I do need to apply for something else, how long does this process normally take? I'm thinking I've left this far too late and I'm going to have to cancel the holiday we have been looking forward to since 2015!

Even after you have British citizenship, you cannot just apply for her British passport without first registering her. So, there is no point in delaying, as the registration fees will only increase as time goes on.

An Immigration Officer should have discretion to admit a non-visa national UK born child back into the UK.

But it may be safer to postpone travel and register her and apply for her British passport under the JCAP scheme.
