Eligible for ILTR

Post by English » Mon Feb 26, 2018 2:06 am

Hello
A little background..
I came into the UK September 2007 as a student on a two years visa to study masters. While I was still studying I applied to extend my stay and was rejected in 2009 on the grounds of late submission, working over 20hrs with no right to appeal. I wrote to the home office explaining my circumstances with reasons arguing on technical grounds which at that time wasn't my fault but didn't get any response. I finished my masters regardless and married a British citizen in 2010. I applied for leave to remain and was granted 30 months discretionary leave march 2011, unfortunately right before my leave expired, i got divorced though still applied for continuous leave ro remain and was rejected with right to appeal, I won the appeal in the 1st tier tribunal but the home office appealed against it on the grounds that I and my ex were divorced at the time of application. The upper tribunal judge granted home office appeal while the case was referred back to 1st tier tribunal. At this time i had started living with my new partner, a British citizen and my daughter was born June 2015. I then made a fresh application on the basis of right to family 10year route and withdrew my appeal. I was granted discretionary leave July 2016. Now I have spent 11years in the UK and my renewal for continuous leave is due end of this year. Please advise if I qualify for ILTR or what happens if I get married to my partner that i have been living with for 3years now with my daughter and expecting another child in 2months.

You are going to have to give us more specific detail for us to guide you further. In particular, the dates of each grant and expiry of visa, the date of each application and of their rejection, and the dates of the appeals.
