Set O application not eligible for upgrade

Post by MsTbaby » Wed Feb 28, 2018 12:22 pm

Hello everyone ;I applied for ILR on 07/01/2028.I applied using set o form as I had completed 6 yes discretionary leave .This morning I applied for the premium upgrade exactly at 08.00.I got an emails 10am informing me that I wasn’t eligible .Does anyone know much about premium upgrades?Im a bit confused at to why it’s not eligible .Im worried too that maybe something is not right with my application .Home office have taken the money for ILR application already .I don’t understand why my application is not eligible for upgrade when it falls under SET O.I know only home office can answer these questions .But does anyone out here know how premium upgrades work ?

As I understood, SET O after 6 years of Discretionary Leave is not eligible to upgrade to Premium according to the link below. I think following statement from Home Office Page looks wrong...

https://www.gov.uk/faster-reply-visa-application
SET (O) form
There are specific rules about getting a faster reply if you applied using the SET (O) form.

You can get a faster reply if you used the SET (O) form and both of the following are true:
  • your case isn’t covered by immigration rules
  • you applied to settle in the UK after completing 6 years discretionary leave granted under the transitional arrangement
I think it should be... You can not get a faster reply if you used the SET (O) form and both of the following are true:

Otherwise, it might mean SET O after 5 years of Tier 2 is not eligible to upgrade if the quote from Home Office page is true which is not a case. In that case, DLR after 6 years would mean not eligible - I guess because it is more complex than regular Tier 2 application.
