Tier 2 Dependent Visa validity after Main Applicants' ILR application

Post by amilau123 » Wed Feb 28, 2018 1:06 pm

Hi,

Wonder if anyone here can help me.

My Situation

I am eligible to apply for ILR since 02 February 2018 (but my Tier 2 visa is valid until 02 February 2019).

My wife came to the UK under Tier 2 Dependent visa on 3 May 2014 however, she was granted visa on 13 December 2013 (There are 144 days of absences). If we consider these 144 days towards the 180 allowed absences in any 12 month period, she will be eligible to apply for ILR in late November 2018. Her Tier 2 Dependent visa is also valid until 02 February 2019).

I am planning to apply for ILR now.

My Questions

1) Can my wife use the 144 days between the day she was granted Tier 2 Dependent visa and the day she first came to the UK towards 180 days allowed absences?

2) If I'm granted ILR, can my wife remain on Tier 2 Dependent visa (We have a daughter who was born in the UK and she also has a Tier 2 Dependent visa) and travel in and out of the UK ?

Any help really appreciated.

Many Thanks,
Amila

Yes. She should remain on the Visa. She would be able to apply for ILR on or after Nov 15, 2018
You can register your child as a british citizen after you get your ILR.
