I don’t think so based on the previous 3 months and March allocation has fewer rcos.

Hopefully with 31 points you might get an approval in April or May becoz these months will have approx 2200 rcos.

But based on the nhs recruitment and nurses fall under shortage occupation no one can predict as uk healthcare sector has a shortage of 35000 employees which are being recruited in overseas.

Thought of starting a new topic on RCOS for March. 200 RCOS are carried over to March and there are some new immigration rules.

This was the article on immigration update. Could not understand the 3rd point clearly does that mean the HO can reset the annual cap before April?.

2018 has already ushered in new UK immigration rules, as well as some other developments that employers should be aware of.

The new rules include:

1. Tier 2 sponsors must now notify the Home Office within 10 working days of becoming aware of changing from a 'small' to 'large' sponsor, or vice versa.

It is the size of your business which, for example, determines the level of Home Office fee you pay when you apply for and renew your Tier 2 Sponsor Licence as well as the amount of Immigration Skills Charge (ISC) when you assign a Certificate Of Sponsorship (COS) which is liable for the fee.

The size of the business is a matter of company law and you will currently be deemed to be a small UK business if you meet at least two of the following in a financial year:

Turnover less than £10.2 million
Balance sheet total of less than £5.1 million
You have less than 50 employees
The question is raised in terms of when a sponsor would become aware of a change in size as above. The Home Office's approach so far has been that it is a question of fact when the business becomes aware, but that certainly when accounts are filed with Companies House it would be difficult to argue the business was unaware of the change.

2. The Home Office has expressed its intention to raise the level of the Immigration Health Surcharge from £200 per year of the leave/visa to £400. Whilst the start date has not been indicated, the Home Office has a habit of increasing fees in April and so it might not be far around the corner.

Employers who are Tier 2 sponsors may also like to be aware of:

3. The need to renew their annual allocation of COS before the 5 April deadline. This is well worth doing so that COS are on hand should you need them urgently. Whilst the £200 priority service can be used as a backup in order to obtain an ad hoc COS within 5 days, there is not a fee in requesting COS as part of the annual allocation process. The fee for the COS and ISC is only incurred when the COS is assigned online. As has been the case in recent years, sponsors should provide as much detail as possible as to why they require the COS, including where possible the personal details of the applicant and the job title/salary/Job Type of the role.

4. Many Tier 2 sponsors will have been caught by surprise that the Tier 2 (General) Restricted COS monthly quota has been oversubscribed since December 2017. Once shortage occupation and PhD level roles have been prioritised in the quota, the applications are primarily assessed in relation to the level of salary on offer. If a quota request is knocked back, so long as the advertisements remain valid, sponsors can enter again the next month.

If times gone by have been anything to go by, it would be expected that the level of applications will even out again and oversubscription will be behind us. On the other hand, these are not ordinary times. With Brexit looming and recent Office for National Statistics showing there are already reductions in EU nationals arriving in the UK and more leaving, UK immigration policy is up in the air. The situation is compounded by the Immigration Minister recently being unable to rule out UK visas being offered as part of new trade deals with non-EU countries, such as the US, India and Australia. Given all that, it is no surprise the long awaited post Brexit white paper on UK immigration policy and Immigration Bill have been delayed and, it is understood, are unlikely to be released until after the Brexit transition deal has been reached.

We will continue to keep you updated with UK immigration law changes.

The content of this article is intended to provide a general guide to the subject matter. Specialist advice should be sought about your specific circumstances.

I think the third point refers to unrestricted COS.

There appears to already be a topic on March RCoS. The moderators way want to merge them.

Hi Hopeful42, hope you are well. Looks like your RLMT is in progress isn't it.
Coming to the post there is no cap on COS so it refers to RCOS I guess.

Hi krimurthy, yes I hope you are well too. Yes my RLMT is in progress so I don’t think I’ve been submitted for RCoS in March.

Does anyone know which point is correct?

45k = 45 points
49k = 45 points ? or 49k = 49 points ?

I have 45k with points, and I will apply for the April (second attempt).

I wonder how many time can I attempt?

Thanks and good luck to people who apply for the March.

My company is applying for me for the 1st time with 30 points. Based on last few months' allocation, I don't have any expectations of approval for this month. The lawyer firm has already told me that there are no chances for this month, but they are hopeful in April. Hope that home office clears the backlog in the month of April.

I doubt for 30 points in April too, I may at least take 2-3 month to come to normal state

For RLMT applications, applications with salary between 45,000 to 49,999 are scored at 45 points

You can get it in may or June because people who have applied in Dec and Jan with RLMT done in Nov Dec will expire in May so many of those who applied after Jan have good chance in Apr or may max June. With less than 35 points.

Hi Friends, I got a A rated sponsor with a salary of 85K per anum. My job is not listed in shortage occupation list.

Sponsor is applying for RCoS for march 2018.

Any idea what are the chances of it getting picked?

Thanks in advance

You are making a mockery of us with 30 and 40 odd points L. You will definitely get it unless your sponsor makes any mistakes any documentation in RLMT as such.

The reason I asked is there are very few RCOS for march around 1200 and lot of shortage occupation are pending from long time .

4. Many Tier 2 sponsors will have been caught by surprise that the Tier 2 (General) Restricted COS monthly quota has been oversubscribed since December 2017. Point 4 is a bit concerning.

If I'm correct, the article is trying to suggest that past statistics where oversubscription of quota evened out the next few months, is unlikely to happen as 'Brexit' is around the corner - meaning that either 1) quota might continue to be oversubscribed this year for consecutive months or 2) the points requirement will remain high at around 46+.

Somehow it also seems contradictory, if more EU nationals are leaving UK lately, then immigration levels are dropping which should only increase placements for overseas skilled recruits? Atleast until Brexit happens on March 2019, non-EU recruits do not have to compete with EU nationals for Tier 2 General visa.

Also starting to personally believe that April quota might remain at 20,700 and a low chance of HO exempting overseas nurses from this quota.

@krimurthy - could you kindly share the source of this article please?

Hey guys

Second time applying this month with score of 36. So disappointed that this is all occurring and can’t believe the lack of want to resolve this issue from the home office.
Surely after 3 months of this something needs to be done as they are going to likely create further job shortages in the coming months.

I am lucky my employer has however created a new RLMT for me at 41 points for April which is the one I’m hoping to have enough for. Good luck to all.

@mschase this is an article from an immigration website. Don't think I can share the author info and other over here. Coming to quota it will get better if not 30 it will get back to 40 by may the reason is all the backlog application will start expiring due to 6 months RLMT validity. I also believe HO will do something to clear the backlog as it has been reported in all the news paper about the issue.

Applying via Milkround awards you with 30 points and a salary of 36k is 16 points, hence 46.
