Someone please help I am very stressed.
I put in an spouse visa application for my husband in December and was refused in February. I receive carers allowance and income support. I am a full time carer for my mother and my younger sister who is partially sighted. From 2013 I have been looking after my mother and sister and since then my mother has been giving me money for the extra caring duties for looking after my younger sister.
When I applied there was a written statement from my mother stating she was giving £70 every week and adding that up I was receiving enough to support my husband when he comes over. We live in a rented property and housing benefit covers the rent.
When we received the refusal letter they had stated they do not believe that my mother has been giving me money because there is no proof in the bank statements even though I thought a statement would be enough. Also the second reason was they were deducting rent of £132 a week from my carers allowances and income support which every week adds up to £92.85 and that would leave me with -£39.15.
So I suggested I should put in a new application because appeal will take long and I really need my husband here but my solicitor has said they have got all this wrong and instead of putting a new application in and maybe having it refused again I should appeal because I have a better chance of winning.
Has the ECO got all this wrong and what is the best thing to do now?
