You can apply for confirmation of British nationality or apply for a summon, so she can come to the tribunal to give evidence.

With the birth Certificate, Home office ought to have assisted.

The court paper will provide details of your son which you can surely use.

What is the position with the family court?

There are procedures you undertake to establish a child's nationality, and one is to apply for a proof of nationality, and i believe that at the birth registration, those information would have been requested and provided.

What is the mother's nationality, is she a british citizen or an EEA national.

I believe those representing you in the family law matters or the immigration matters should have been able to help you establish this.

Any body born in the uk before 1983 is British citizen.
If you wife was born before 1983 then order her birth certificate and your son birth certificate.
If she was born after 1983 then get the birth certificate for your son , your ex wife And her mother.
It will establish the nationality.
I am assuming they were All born in the uk.

I believe Home Office should have assisted. I do not know why they acted in this way, to suppress the court order.

I have made 3 previous applications where in 2 mother refused to give the passport, and 1 it was the father, and in all of them, the Home Office appreciated the difficulties and grant without the passport. I am a little puzzled as to why they were harsh in your case.

Did your solicitor state the difficulties as ask them to check from mother's record on whether she has been issued a passport before?

To get copies of her birth certificate, you will need to know the full name of her parents, the year she was born, and what hospital she was born at. There is no requirement for her signature.

You didn’t read my post properly.
If your ex was born in 1989 then her mom was definitely born before 1983 and if she was born in the uk then all you need is birth certificates for your child and child mom and grandma.
I have recently done this and it was accepted my wife never had a British passport but we proved it with birth certificates.
As obei already advised any body can get anyone’s birth certificate.

I feel sorry about what you are going through and can completely understand your pain but don’t panic it will be ok in the end.
A lot of people go through the same or worse.
If you know the fathers first name then surname is likely to be same as your wife.
If you go into registrar general Office they can try to search even if you don’t know full details.
Try getting your ex fathers marriage certificate that should have details of both her parents and address at the time.

No I did not say so. Please do not misquote or misrepresent me to give the impression that I am advising people to engage in criminal conduct.

I only state the requirements for getting a duplicate birth certificate, I did not say anybody can get anybody's birth certificate.

I take exception to people wrongly misrepresenting and misquoting what I say.

My mistake if you didn’t mean that.
That’s what I believed is the case with births and marriages records.
But is it not a public record ?
