Wanted to seek guidance on my circumstances
I had got my Tier 1 visa in May 2010. It was valid for 2 years. I came to Uk in Aug 2010 but went to work in Middle East in Nov 2010.
1st Extension
Came back in 2012 to UK apply for Tier 1 extension. Got extension which was valid it May 2015However after getting extension, I had to go back to Middle East to resume work.
2nd Extension
Came back on 17th May 2013, after which I have been based in UK and have not been out of the country for more than 30 days consecutively or otherwise.
I got my second extension before 6th April 2015 as Home Office rules did not permit any extensions beyond this date, although my visa would have expired on 17th May 2015.
Question
As per changes made in rules, I would need to apply before 6th April 2018 for ILR, however my exact 5 years would complete on 17th May 2018. And even if i can apply 28 days in advance even then i will be 20 days. Hence Question is can i claim 2 months (when i had valid visa) but was not physically in UK in my continuous period. This was time in March & April 2013, before my arrival back to UK in May 2013.
