Hello,

I have some questions relating to the statement in the guide. I've looked through the forum to understand this but I still have some doubts.

You must also check that you were physically present in the UK 5 years (3 years if
you are married to or in civil partnership with a British citizen) before the date that the
application will be received by the Home Office or other receiving authority (see
“Where to send your application form” in this guide). If you do not meet this
requirement your application is unlikely to be successful, unless you were in the UK
armed forces at that time.


1. Does it mean:
  • That I have to be in the UK exactly 5 years before my application?
    i.e. IF I submit my Online application on the 10/03/2018 I have to make sure that I was in the UK on 10/03/2013
  • That I have to be on that day every day for last 5 years? That means on the 10th of March 2013-2018
It looks maybe simple but confusing as some friends say one thing the others second :? .

2. By doing an online application, what time is treated as "the date that the
application will be received by the Home Office or other receiving authority"
. Is it the date of submitting the application?

3. Is it relevant only to the main applicant (I am doing it for myself, wife and daughter) or for all of us?

Hi Maciek,
Did you get any advise on this? I am also struggling with the second question you paused. I was in the country on 11 March 2015 and then traveled for a week, I was planing to submit my application online on the 11th of march and send my documents through the council on the 19th so technically I was in the country on the day they received the online application and the day they received all the docs. Do you think this is safe or I should just apply after the 19th?
